Update on the Force Majeure Notification COVID-19 dated March 16, 2020 and subsequent notifications for TE Connectivity Germany GmbH, Wört
Dear Madam or Sir,
we are issuing this letter in furtherance to the Force Majeure letters that were previously issued by us namely on March 16, 2020 and December 10, 2020.
The COVID-19 pandemic is increasing the disease numbers whole over Europe. Furthermore, the new mutations of the COVID-19 are causing significantly higher numbers of infections, which also negatively impact our production capability. TE Connectivity implemented in line with local government rules and regulations, internal protective measures at an early stage that were aimed at avoiding the risks of employee infection. Measures included working in home office wherever it is possible and reducing personal contacts for those who must continue to work in our plants to keep our operation running.
Despite the above described efforts to mitigate any negative impacts, the number of infected colleagues is increasing. Today, the public health office responsible for our plant in Wört advised that due to a COVID-19 outbreak, including the new mutation, amongst our employees in Wört, our stamping department needs to remain partly closed for at least 14 days. Moreover, a number of close contacts must immediately be self-quarantined. This directive from the public health authority will cause a delay in shipments.
We would like to point out that the disruptions caused by the order of the public health authority represent an event of Force Majeure beyond our control. TE Connectivity explicitly rejects any liability for potential claims or damages in connection with this Force Majeure event. The initial TE Connectivity and affiliates Force Majeure declaration from March 16th, 2020 and subsequent updates continues to remain in full force and effect.
